Collins Creative ("Contractor," "we," "us," or "our") is a social media management and content creation business operated by Claire Collins in Eau Claire, Wisconsin. These Terms of Service govern your use of our website (www.collinscreative.info), our social media channels, and any services we provide.
2. Services
Collins Creative offers social media management, content creation, strategy and planning, community management, and related digital marketing services as described on our website. Service packages, pricing, and deliverables are outlined on our Packages page and may be updated from time to time at our discretion. Specific service terms for each client engagement will be outlined in an individual service agreement or contract.
3. Independent Contractor Relationship
Collins Creative and any subcontractors we work with operate as independent contractors. Nothing in these Terms or in any service agreement shall be construed to create an employer-employee relationship, partnership, or joint venture between Collins Creative and the Client.
4. Client Responsibilities
By engaging Collins Creative for services, you agree to:
Provide timely access to all relevant tools, platforms, accounts, and login credentials necessary for us to perform services on your behalf.
Respond to content approvals, feedback requests, and communications in a timely manner to avoid scheduling delays.
Provide accurate and complete information about your business, brand guidelines, and content preferences.
Collins Creative is not responsible for delays, disruptions, or service limitations caused by a Client's failure to provide necessary access, approvals, or information.
5. Intellectual Property
All content, materials, and creative work produced by Collins Creative remain the property of Collins Creative until payment has been received in full. Upon receipt of full payment, the Client is granted a non-exclusive, royalty-free license to use the delivered content for their own marketing purposes during the active term of the service agreement. This license expires upon termination of the agreement.
Collins Creative retains all rights to creative methods, processes, strategies, templates, and raw content files (including original photo and video files). Collins Creative may display completed work in its portfolio, on its website, on social media, and in other promotional materials, provided that confidential business information belonging to the Client is not disclosed.
6. Payment Terms
Service fees are based on the package and add-ons selected by the Client, as outlined in the applicable service agreement. Payment terms, due dates, invoicing schedules, and accepted payment methods will be specified in the individual service agreement. Late or missed payments may result in a pause or suspension of services until the outstanding balance is resolved.
7. Confidentiality
Both Collins Creative and the Client agree to maintain the confidentiality of any proprietary, sensitive, or non-public information shared during the course of the working relationship. This includes, but is not limited to, business strategies, financial information, customer data, login credentials, and unpublished content. This confidentiality obligation survives the termination of any service agreement.
8. Content Approval and Edits
Collins Creative's workflow includes a content approval process. Clients will have the opportunity to review and approve all content before it is published. One round of edits is included per content piece as part of the standard workflow. Additional revision requests beyond the included round may be subject to additional fees as outlined in the service agreement.
9. Third-Party Platforms
Collins Creative publishes content on third-party platforms including, but not limited to, Instagram, Facebook, TikTok, LinkedIn, and Pinterest. We do not own, operate, or control these platforms and are not responsible for changes to their algorithms, policies, terms of service, functionality, outages, or any actions taken by these platforms (including content removal, account suspension, or reach limitations). Performance results may vary based on platform changes outside of our control.
10. Website Use
By using this website, you agree not to:
Use the site for any unlawful purpose or in violation of any applicable laws or regulations.
Copy, reproduce, distribute, or create derivative works from any content on this website without express written permission from Collins Creative.
Attempt to interfere with or disrupt the functionality, security, or accessibility of this website.
All content on this website — including text, images, graphics, logos, and design elements — is the intellectual property of Collins Creative and is protected by applicable copyright and trademark laws.
11. Limitation of Liability
To the fullest extent permitted by law, Collins Creative shall not be held liable for any indirect, incidental, consequential, or special damages arising from or related to the use of this website or our services. This includes, but is not limited to, loss of revenue, loss of followers, decreased engagement, or any damages resulting from third-party platform changes, outages, or policy updates.
Collins Creative's total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the Client for services during the month in which the claim arose.
12. Termination
Either party may terminate a service agreement in accordance with the terms outlined in the individual service agreement. Upon termination, the Client's license to use content created by Collins Creative expires, and any outstanding payments for services already rendered become immediately due. Collins Creative reserves the right to suspend or terminate services for non-payment or breach of these Terms.
13. Disclaimer
Collins Creative does not guarantee specific results, including but not limited to follower growth, engagement rates, website traffic, or revenue increases. Social media performance is influenced by many factors outside of our control, and all strategies are developed in good faith based on current best practices and platform guidelines.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any disputes arising under or in connection with these Terms shall be resolved in the courts located in Eau Claire County, Wisconsin.
15. Changes to These Terms
Collins Creative reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of this website or our services after any changes constitutes your acceptance of the revised Terms.
